Terms & Conditions

A. Driver Agreement (Independent Contractor Agreement)

This Driver Agreement ("Agreement”) is entered into between ByRyde ("Company”) and the independent contractor driver ("Driver”).

1. Independent Contractor Status

Driver acknowledges and agrees that they are an independent contractor and not an employee of ByRyde. Driver is fully responsible for determining work hours, selecting which rides to accept, maintaining their vehicle, and managing their own taxes, insurance, fuel, and expenses.

2. Driver Responsibilities

Driver agrees to:

  • Maintain a valid driver’s license.
  • Maintain required auto insurance at all times.
  • Maintain a clean, safe, and operable vehicle.
  • Operate the vehicle in compliance with all applicable laws.
  • Treat riders respectfully and professionally.
  • Avoid harassment, discrimination, or unsafe conduct.

3. Earnings

ByRyde:

  • Collects rider payments.
  • Retains a platform fee.
  • Pays Driver the remaining portion.
  • Driver is solely responsible for tax reporting.

4. Safety Requirements

Driver shall:

  • Use the ByRyde app while on duty.
  • Not operate the vehicle under the influence.
  • Comply with traffic laws and safe-driving practices.
  • Report unsafe rider behavior.

5. Background Checks

ByRyde may conduct identity, motor vehicle, or criminal-history checks.

6. Termination

Either party may terminate this Agreement at any time. ByRyde reserves the right to deactivate Driver accounts for violations.

7. Liability

Driver assumes all liability for accidents, damages, injuries, and violations.

B. Rider Agreement

By using the Platform, you ("Rider”) agree to the following terms:

1. Nature of the Platform

ByRyde is a technology service connecting riders with independent drivers. ByRyde does not provide transportation services.

2. Payment Authorization

Rider authorizes ByRyde to automatically charge fares, tolls, fees, and cancellation charges.

3. Rider Conduct

Rider agrees to:

  • Behave respectfully toward drivers.
  • Avoid damaging vehicles.
  • Follow local laws and safety guidelines.

4. Ride Safety

Rider understands that all transportation carries inherent risks. ByRyde provides GPS tracking for safety but cannot guarantee outcomes.

5. Account Compliance

ByRyde may suspend Riders for harassment, fraud, safety violations, or policy breaches.

C. Liability Waiver

By using ByRyde, you release the Company from liability to the fullest extent permitted by law.

You acknowledge that:

  • Drivers are independent contractors.
  • ByRyde is not responsible for driver behavior.
  • ByRyde is not liable for injuries, losses, damages, or incidents occurring during rides.

D. Safety Policy

ByRyde maintains a high standard of safety. Key components include:

1. Driver Verification

  • Insurance validation
  • Driver’s license verification
  • Identity checks

2. Trip Tracking

All rides are GPS-tracked for accountability.

3. Rider Safety Tools

In-app messaging, anonymized contact, and trip details are provided.

4. Zero-Tolerance Rules

No harassment, violence, threats, or intoxicated driving are permitted.

5. Incident Reporting

Reports may be submitted through the ByRyde app or by email.

E. Cookie Policy

ByRyde uses cookies for:

  • Analytics
  • Site performance
  • User preferences

Users may disable cookies through their browser settings.

F. Refund Policy

Refunds may be granted for:

  • Duplicate charges
  • Technical failures
  • Verified major ride issues

Cancellation fees are non-refundable except in cases of system error.

G. Insurance Disclosure

No Primary Insurance Provided by ByRyde. ByRyde does not provide primary automobile insurance for Drivers. Each Driver must obtain and continuously maintain, at the Driver’s own expense, automobile insurance that complies with all applicable laws and expressly covers transportation-network or rideshare activities.

At a minimum, Drivers must maintain the following coverage:

  • Online and available for ride requests, but not engaged in a ride: Primary automobile liability coverage of at least $50,000 for bodily injury or death per person, $100,000 for bodily injury or death per accident, and $25,000 for property damage per accident.
  • During a prearranged ride: Primary automobile liability coverage of at least $1,000,000 for death, bodily injury, and property damage.

Drivers must provide proof of the required insurance upon request and immediately notify ByRyde of any cancellation, expiration, lapse, restriction, or material change in coverage. A Driver must not log in to the ByRyde platform or provide rides without the required insurance.

To the fullest extent permitted by law, ByRyde is not responsible for:

  • The condition, maintenance, safety, or roadworthiness of a Driver’s vehicle;
  • A Driver’s failure to obtain or maintain the required insurance;
  • Any cancellation, expiration, lapse, exclusion, deductible, coverage limitation, or denied insurance claim; or
  • Damages, losses, or injuries arising from a Driver’s operation of a vehicle, except where responsibility cannot legally be excluded.

ByRyde is not an insurance company, insurance agent, or guarantor of coverage. Nothing in this section limits any responsibility or legal right that cannot lawfully be waived.

K. Intellectual Property Notice

All trademarks, logos, app designs, names, and content belong to ByRyde Corporation.

Users may not copy, modify, distribute, or reverse-engineer ByRyde materials.

L. Community Guidelines

Users agree to:

  • Treat others with respect.
  • Follow applicable laws and safety rules.
  • Avoid abuse, threats, or discriminatory conduct.
  • Drivers must keep their vehicles clean and safe.
  • Riders must avoid property damage and follow safety instructions.

M. SMS Consent Policy

By creating a ByRyde rider or driver account, entering your phone number, or using ByRyde services, you agree to receive transactional SMS text messages from ByRyde.

ByRyde may send SMS messages for:

  • Account verification codes
  • Ride-request updates
  • Driver pickup notifications
  • Driver arrival notifications
  • Trip-status updates

ByRyde SMS messages are service-related and are used to help riders and drivers use the ByRyde app safely and properly.
